Terms of Service

1. The Services

TutoCoder offers online developer tools, programming and computing courses, and mobile applications. We may add, change, suspend or discontinue any part of the Services at any time. Some features may require an account, and some Apps may have their own additional terms, which will be shown to you before you use them.

2. Eligibility and age

You must be at least 13 years old, or the minimum age required in your country, to use the Services. If you are under 18 (or the age of majority where you live), you may only use the Services with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.

3. Accounts

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• If you sign in with Google, Facebook or Apple, you must also comply with that provider's terms.
• Tell us immediately at [email protected] if you suspect unauthorized use of your account.
• You can delete your account at any time as explained on our account deletion page.

4. Acceptable use

You agree not to:

• break any law or infringe the rights of others;
• upload content that is illegal, offensive, harassing, sexually explicit, hateful or that infringes intellectual property;
• use a profile photo or name that impersonates another person;
• attempt to access accounts, systems or data without authorization, or interfere with the security or operation of the Services;
• copy, modify, decompile or reverse-engineer the Services, except where the law expressly allows it;
• use bots, scrapers or automated means to access the Services, or generate fraudulent ad clicks or impressions; or
• resell or commercially exploit the Services without our written permission.

5. Your content

You keep ownership of the content you submit, such as your profile photo or information you save in an App. You grant TutoCoder a worldwide, non-exclusive, royalty-free license to host, store, reproduce and display that content only as needed to operate and provide the Services to you. This license ends when you delete the content or your account, except for copies kept temporarily in backups or as required by law. You are responsible for the content you submit and confirm that you have the right to share it.

6. Advertising

Some Services are free because they show advertising, including ads served by Google AdMob. Ads may be personalized as described in our Privacy Policy. We are not responsible for the products, services or content of advertisers.

7. Purchases and subscriptions

Some Apps may offer paid features, in-app purchases or subscriptions. Payments are processed by Google Play or the Apple App Store and are subject to their terms, including their refund policies. Subscriptions renew automatically until you cancel them in your store account settings. Prices and features are shown before you buy. Course fees, when applicable, will be communicated to you before enrollment.

8. Courses and educational content

Our courses and materials are for educational purposes. We do our best to keep them accurate and up to date, but we do not guarantee any particular result, job or certification. Course materials are for your personal use and may not be redistributed.

9. Tools

Our tools are provided for convenience. You are responsible for checking their results before relying on them, especially in production systems or for security purposes.

10. Intellectual property

The Services, including their software, design, text, graphics, logos and the TutoCoder name, are owned by TutoCoder or its licensors and are protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the Services according to these Terms. All rights not expressly granted are reserved.

11. Third-party services and links

The Services may include links to or integrations with third-party services (such as Google, Meta or Apple). We do not control them and are not responsible for their content, policies or practices.

12. Privacy

Our Privacy Policy explains how we collect and use personal data, including name, age, email, profile photo, social sign-in and advertising data. It forms part of these Terms.

13. Disclaimer of warranties

The Services are provided "as is" and "as available". To the maximum extent permitted by law, TutoCoder disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free or free of harmful components.

14. Limitation of liability

To the maximum extent permitted by law, TutoCoder will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or business, arising from or related to your use of the Services. Our total liability for any claim related to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50.

15. Indemnification

You agree to indemnify and hold TutoCoder harmless from any claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms, your content or your misuse of the Services.

16. Suspension and termination

You may stop using the Services at any time. We may suspend or close your account, with or without notice, if you breach these Terms, if required by law, or to protect the Services or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability and governing law) will continue to apply.

17. Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date above and, for significant changes, notify you in the App or by email before they take effect. If you keep using the Services after the changes take effect, you accept the updated Terms.

18. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Guatemala, without regard to its conflict-of-law rules.

Any dispute, claim or controversy arising out of or relating to these Terms or the Services will be submitted to the courts or venue that TutoCoder chooses at its discretion, which may be the competent courts of the Republic of Guatemala or any other competent court. You consent to the jurisdiction of the chosen venue and waive any objection to it, to the extent permitted by applicable law.

Nothing in these Terms removes any mandatory rights you may have as a consumer under the laws of the country where you live.

19. General

These Terms, together with the Privacy Policy, are the entire agreement between you and TutoCoder regarding the Services. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition or sale of assets. If there is any conflict between language versions of these Terms, the Spanish version prevails.
